Stamp duty is computed on the higher of (a) actual transaction value and (b) circle rate / government guideline value / ready reckoner rate. This is to prevent under-valuation of property in sale deeds.
Registration fee is uniformly 1% of the property value across most states, capped at ₹30,000 in some states (Telangana). Registration is mandatory for any property transfer — unregistered transfers do not confer title.
Telangana and Andhra Pradesh: 1% lower stamp duty for properties registered in female name. Karnataka: 2% rebate. Tamil Nadu: 2% rebate. The rebate is applied only if the property is solely in the woman's name, not joint ownership.
TDS at 1% is applicable on property transfer exceeding ₹50,00,000 — buyer deducts and deposits with the government. Seller can claim credit while filing ITR. NRI seller — TDS at 20% under Section 195 with DTAA benefit where applicable.
Mumbai and Pune: 1% metro cess in addition to stamp duty. Many municipal corporations levy additional development charges, parking charges, and betterment charges on top of stamp duty at the time of registration.
